1. Agreement to Terms

By accessing our website or purchasing IndyPendants Medical Alert Systems products and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Services

IndyPendants provides personal emergency response systems (PERS) that connect users to our 24/7 USA-based emergency call center. Our services include:

  • Medical alert devices (Indy at Home, Indy Mobile, Indy Smartwatch)
  • 24/7 emergency monitoring and response
  • GPS location tracking (select devices)
  • Fall detection services (select devices)
  • Caregiver notification services

3. Subscription & Billing

  • Services are provided on a month-to-month or annual subscription basis with no long-term contracts required
  • Annual plans are billed upfront and include a discounted monthly rate
  • Monthly plans are billed at the beginning of each billing cycle
  • Prices are locked in at the time of purchase — we guarantee no price increases for the duration of your subscription
  • All prices are listed in US dollars and exclude applicable state and local taxes

4. Equipment

Medical alert devices remain the property of IndyPendants and are provided to you for the duration of your active subscription. Upon cancellation:

  • You must return all equipment within 30 days using the prepaid shipping label we provide
  • Failure to return equipment may result in a non-return fee
  • Equipment returned in damaged condition (beyond normal wear) may incur a replacement charge

5. Cancellation

You may cancel your subscription at any time by calling 877-463-9736 or emailing support@myindypendants.com.

  • Monthly plans: Cancellation takes effect at the end of the current billing period
  • Annual plans: Unused months may be eligible for a prorated refund, subject to our Return Policy
  • Monitoring services will continue until the end of your paid period

6. Limitations of Service

While we strive to provide reliable emergency response services, please understand:

  • Our devices rely on AT&T 4G LTE cellular networks and may not function in areas without coverage
  • Fall detection technology is not 100% accurate and may not detect all falls or may trigger false alerts
  • GPS accuracy depends on satellite signal availability and environmental factors
  • Our service is not a substitute for 911 or professional medical care
  • Power outages exceeding the backup battery duration may interrupt home-based service

7. User Responsibilities

  • Test your device regularly by pressing the help button (our team will confirm the test)
  • Keep your emergency contact information and medical profile up to date
  • Charge portable devices as recommended
  • Do not modify, disassemble, or tamper with the equipment
  • Notify us immediately if your device is lost, stolen, or damaged

8. Limitation of Liability

To the maximum extent permitted by law, IndyPendants shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services. Our total liability shall not exceed the amount you paid for services in the 12 months preceding the claim. This limitation does not apply to damages caused by our gross negligence or willful misconduct.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms shall be resolved through binding arbitration in accordance with applicable rules.

10. Changes to Terms

We reserve the right to update these Terms of Service at any time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before taking effect. Continued use of our services after changes constitutes acceptance.
